- Assignment of contract: We may assign our rights and obligations under a purchase contract to a third-party buyer for an assignment fee. An assignment of contract means that the third-party buyer steps into our position and proceeds to close the transaction. The original property owner receives the agreed purchase price regardless of whether we close directly or assign the contract.
- Cash offers: Any cash offer we present represents our genuine assessment of the property’s value and our intent to purchase or assign at that price. However, no offer is binding on either party until a written purchase agreement is fully executed by both parties. See Section 5 for additional details.
- No guarantee of closing: While we endeavor to close on every contract we enter into, the completion of any transaction is subject to due diligence, title review, financing, and other contingencies. The existence of a purchase agreement does not guarantee that a closing will occur.
3. No Brokerage Relationship
Golden Rose Advisors is not a licensed real estate brokerage and does not hold a real estate broker’s license in New York State or any other jurisdiction. We do not act as a real estate agent or broker for property owners, buyers, or any other party in connection with our wholesaling activities.
When you engage with Golden Rose Advisors, no agency relationship, fiduciary duty, or brokerage relationship is created between you and Golden Rose Advisors. We act as a principal — a buyer or contract assignor — in all transactions. We do not represent your interests as an agent, and we are not obligated to obtain the highest possible price for your property or otherwise act in your best interest in the way a licensed agent would.
We strongly encourage all property owners to consult with a licensed real estate attorney before signing any purchase agreement or other contract with Golden Rose Advisors or any other party. You have the right to seek independent legal counsel, and we support your exercise of that right.
